Are all Marvel pins now Disney pins!?

I've had a related dilemma - I was given a new promotional pin of a spider that promotes the new Amazing Spider Man movie. No Disney copyright on the back as the film was released by a different studio (Sony I think). Not really sure whether to list the pin or how to list it. Comes with a separate promotional card about the movie.
Also have a bunch of older Batman movie buttons that I've been meaning to list (or see if they're listed) as I think PinPics does have a DC category? Seems if they have a DC/WB category that they should have a separate Marvel category too.
Don't the official pin trading rules say that there must be a Disney backstamp? Personally, I wouldn't consider these Disney myself. You could probably trade them to cast members as most of the time they don't actually check to make sure the pin is legit, but I wouldn't if I had them personally, because the person that trades for it after you might be upset it's not an offcial Disney pin, or the cast member could get in trouble if anyone relased it didn't have a Disney backstamp.
I'd love to hear what an experianced cast member who would know would say about this.
