So. Just got off a second call with eBay. Was told and I will quote "If you receive a counterfeit item, don't immediately ask for a refund, try to work it out with the seller". And - "you are responsible for knowing if the item you are bidding on is counterfeit or not".

My ban holds, I am not protected by the buyer protection program any longer, and all my feedback left if not positive 5* all the way is gone.

2 of the sellers are selling counterfeit pins obviously now, and have 1 or fewer negative comments. One of those sellers has sold 16 of different forms of WDI and DSF Jessica pins in the last 15 days, and has the same pin listed again.

I am interested to find more buyers who have had similar experiences with EBay to collect our stories and let the media know. Perhaps this will spur both EBay to clean up their site and fix some policies, and Disney to crack down on some of these sellers.
 
Oh, I'll be reporting there as well, but I think the media might have a field day if they have more than one person who has this issue.
 
I had an experience on eBay where I bought a ds Jessica as queen of hearts from a seller. It was an obvious fake so I asked for a refund and got one. The same seller has relisted and sold the pin multiple times, as well as sells the ds Jessica as Alice multiple times. The seller obviously has a drawer full of these highly sought after (if real) fake pins. I'll be honest, I didn't leave any feedback because the seller hadn't left any feedback for me and I was worried that I may get a retaliation negative feedback against me. I did post about the incident on the forum and found at least 1 other member who purchased from the same seller and had a similar poor experience.

So, Ebay is turning a blind eye to counterfeit items/sellers as long as they get their fees and comissions. They are almost willingly providing a venue for counterfeit sellers to rip off the buyer. This is very frustrating :(

I am so sure that they have a huge legal team that has all the necessary protective measures in place if somebody makes noise. This is even more frustrating. Ugh ....

Contact Disney intellectual property rights, have them back you to eBay to remove stuff. I deal in golf clubs all the time and Cleveland Golf filed a suit against eBay for allowing counterfeit sales of their clubs. Now if someone so much as emails eBay an item could be fake, they pull the listing super fast. Tell the seller they can't sell it.
 
Unfortunately that's how eBay is, if you report too many sellers or if you file too many cases YOU are the one that ends up getting in trouble. 9/10 times the seller never gets punished but buyers do. Also the thing people don't realize is if you continue to have bad experiences with more than one seller and constantly post negative feedback, ebay will then pull ALL negative feedback. Which is why most of those sellers have hardly any negative ratings because majority of ebay buyers don't realize or know that the more negative they leave, the more it counts against them and it gets pulled. And ebay's reason? "You're posting too many negative feedback/opening too many cases against their policy." Which is SELLER protection. Really sneaky and unfair to buyers, but protects the seller.

What does that mean for the innocent buyer getting scammed?
The fine print of the buyer protection is only IF the seller accepts refunds. If the seller doesn't accept refunds and you constantly open cases on sellers that doesn't accept refunds, YOU will not only have all the negative feedback removed from the entire year but you will also be punished in terms of account suspension & buying/selling restrictions.

Ebay has this fine print too so they aren't doing anything illegal but you can TRY to get the scrapper sellers in trouble with a lawsuit, just not Ebay.

Dalisair keep up the good work. Last year I bought several lots on EBay from sellers I suspected of selling counterfeit pins. I inspected the pins and confirmed that my suspicions were true. I reported each seller to EBay for selling counterfeit pins. I also reported each seller to ICE, I included there EBay ID and there real name and address. I kept all the pins. They are still sitting on the shelf in my office. Never heard back from EBay or ICE. I have heard rumours of on going investigations. ABC action news has an ongoing theme about MADE IN AMERICA I sent them an email asking them to do a story on counterfeit Disney pins from China. They sent me a nice form letter.

Keep on ging with the strong fight Dalisair. I too have noticed that too many LE Jessica, Stitch, & DSF pins keep getting sold by the same sellers over and over. When I see that kind of pattern going on, I avoid those sellers. And I know of 2 that do this and I avoid them. Go to the press, go to news channels. This will never end until it's exposed.
 
Well, I'm so glad I've read this post. I use eBay quite a bit for pins and other things. I must say before I will even buy anything, I run the buyer through tons of questions about the pins. I check pin pics to see if there are any differences that I can see from the pics on the computer. I try to follow the guidelines for spotting fakes that DPF has provide for us as we'll. I have a handful of sellers that I have saved that usually I only deal with. I know this is NOT a true way of telling good sellers from bad ones but if their location is not from Florida or California, I usually won't buy from them either. I'm so glad I've read this so if I do get fakes in the future, I know more of how to handle it. I hate it for you so badly. I know you have your own check systems in place as well. It's horrible to get taken advantage of and have no protection for you as the buyer. I hate to say it. eBay is protecting the seller because without them they would lose money. They need sellers to keep the bay running. You know. It's a shame.
