I´m wondering why you can´t mark it as a gift? When I sell something, I only accept PayPal as payment, but I also always mark the package as gift to help my customers and most of my customers don´t have to pay custom fees. Of course sometimes, custom office wants to see the bill, than the customer has to pay, but nothing ever happened to me. That´s why I´m wondering... maybe there are some international laws I´m not aware of?

I think it is the law that if you sell something it has to be marked as merchandise (or whatever it is on the form) I'm not sure though, like a tax fraud or something? Idk. I just REmember once buying something off eBay from the US and asking if it could be marked as gift and they said that would be illegal haha. But I think for something of this price it might be too much to risk if you got found out maybe? I'm sorry if none of what I said is true haha
Most custom services also look at the value and they often don't care if it's a gift. So even if they would mark it as a gift, the buyer would still have to pay custom fees because of the high value (again, in most countries, not all). Some people ask to lower the value on packages such as pins and such but I really don't recommend doing this for values such as $400. ilia89 already explains it really well.I´m wondering why you can´t mark it as a gift? FTR, paypal doesn't know / care / see what's marked on the customs form. They only care about the tracking number and how / where / when it tracks. Sorry to keep this derailing convo going, just wanted to make that last
point. I'll shut up now I promise.

the post office won't give the money back as it was only a gift. So the seller will be out the item+the money they got and not get it back.
As far as I know US works the same way as every other country, but the idea of a gift is it having no value (ie paying no custom fees) so what value/insurance can you get back? Probably zero or the 5$ you actually put on there. And OlafOlaf is correct, if customs sees a very high valued item marked as a gift they will get digging. They won't believe it's a gift, you will have to proof it and even then you may have to pay customs. So, Story, it's good you don't declare it as a gift
